The European Commission is consulting stakeholders on the potential development of a voluntary Code of Conduct on online fraud and scams under the Digital Services Act (DSA).

The Directorate-General for Communication Networks Content and Technology (DG CONNECT) hosted a workshop today bringing together trusted flaggers, civil society and consumer organisations, further strengthening our cooperation with stakeholders in this area.

This follows a roundtable with the banking and payments sector held on 23 October by DG CONNECT, together with the Directorate-General for Financial Stability, Financial Services and Capital Markets Union (DG FISMA).

Online scams are a growing concern for people across the EU, with one in four peoplehaving fallen victim to online fraud. Many scams start on online platforms and search engines, through scam advertisements, fake profiles or accounts impersonating trusted brands and public figures and lead people into making fraudulent payments.

The discussions with stakeholders explore how online platforms, the banking sector and other actors could work together under a potential code of conduct to strengthen user protection, for example through:

  • the exchange of signals on scam content between banks and online platforms, building on the forthcoming Payment Services Regulation (PSR);
  • the verification of advertisers, in particular of financial services;
  • stronger cooperation with trusted flaggers.

Next steps

In early November, the Commission will also meet providers of very large online platforms (VLOPs) and very large online search engines (VLOSEs). The outcome of the consultations will be presented to the European Board for Digital Services and the Payment Systems Market Expert Group. Together with the Board and the Committee, the Commission will assess the next steps, including whether to proceed with the drawing-up of a code of conduct.

Background

Under Article 45 of the DSA, the Commission and the European Board for Digital Services shall encourage and facilitate the drawing-up of voluntary codes of conduct to address systemic risks online. The forthcoming Payment Services Regulation, pending formal adoption, also calls on the Commission and the Board to facilitate such a code to prevent payment fraud and financial scams.
